These Terms of Service ("Terms") govern your use of elitecollective.properties and the services offered by Elite Collective ("we", "us", "our"). By accessing the site, submitting an inquiry, booking a property, or otherwise engaging with our services, you agree to these Terms.
1. Our Services
Elite Collective offers luxury vacation rental booking, property management services for villa owners, concierge services for guests, and real-estate referral services in the Dominican Republic — primarily in Cap Cana, Punta Cana, Casa de Campo, and Las Terrenas. We act as the booking agent and manager for properties in our portfolio; specific property owners remain the underlying legal owners of each villa.
2. Eligibility
You must be at least 18 years old and legally able to enter contracts to make a booking. The lead guest must be present at check-in and remain so during the stay; the lead guest is responsible for the conduct of all members of their group and for any damage caused during their stay.
3. Bookings
An inquiry is not a confirmed reservation. A reservation is only confirmed when (a) we have provided a written booking confirmation and (b) the required deposit has been received and cleared. Pricing, availability, and terms are subject to change until a reservation is confirmed. Once confirmed, the terms in your booking confirmation control.
4. Payment
Payment is collected per the schedule in your booking confirmation — typically a 30% deposit at booking with the balance due 30-60 days before arrival. Failure to pay the balance by the due date may result in cancellation of the reservation with no refund of the deposit. All amounts are in USD unless otherwise specified.
5. Cancellations & Modifications
See our Cancellation Policy for details on refunds, date changes, and force majeure. Your booking confirmation may include specific cancellation terms that override the default schedule; those will be presented in writing before payment.
6. Security Deposit & Damages
A refundable security deposit is collected before arrival. Damage to the property, theft, or violation of house rules will be deducted from the security deposit with documentation; charges exceeding the deposit may be billed separately. Reasonable wear and tear is not deducted.
7. Guest Conduct
Guests agree to: (a) respect the maximum occupancy of the villa, (b) refrain from hosting parties or events without prior written approval (additional fees apply), (c) comply with all local laws and community rules, (d) not engage in illegal activity on the property, and (e) treat the home, staff, and neighbors with respect. We reserve the right to terminate a stay without refund for serious violations.
8. Concierge Services
Concierge bookings (private chef, transfers, excursions, spa, etc.) are arranged through third-party vendors. Elite Collective acts as an introducer and coordinator. We are not responsible for the acts, omissions, or quality of third-party providers, though we vet vendors carefully and will support you in resolving any issues.
9. Limitation of Liability
To the maximum extent permitted by law, Elite Collective is not liable for (a) personal injury or property damage during a stay, (b) loss or theft of personal belongings, (c) interruptions caused by weather, utilities, or events beyond our control, or (d) any indirect, incidental, or consequential damages. Our aggregate liability is limited to the amount paid by you for the services in question. Guests are strongly encouraged to obtain travel insurance.
10. Intellectual Property
All content on elitecollective.properties — including text, photography, video, logos, and design — is the property of Elite Collective or its licensors and may not be reproduced or distributed without written permission. The Elite Collective name and "Live Elite" mark are protected.
11. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
12. Changes to These Terms
We may update these Terms from time to time. The Effective date at the top of this page will reflect the latest revision. Continued use of the site or services after changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Dominican Republic for matters relating to property stays and Florida (USA) for matters relating to the corporate operations of Elite Collective. Disputes shall be resolved in good faith through direct negotiation; failing that, by binding arbitration in Miami, FL.
